1. Acceptance of Terms

By accessing or using Pelican Media Haus’s services, website, or SMS communications, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use our services. These Terms apply to all visitors, prospects, and clients.

2. Services

Pelican Media Haus, operated by Space Coast Aerial Solutions LLC, provides video marketing, video production, paid advertising management (including Meta/Facebook, Instagram, and Google Ads), real estate media (photography, drone, video, Matterport), and related creative services. Specific project details, deliverables, pricing, and timelines are defined in individual service agreements or statements of work executed between Pelican Media Haus and the client.

4. Advertising Performance Disclaimer

Pelican Media Haus provides marketing and advertising services designed to generate leads, inquiries, and brand awareness for clients. While we use industry best practices and proven creative frameworks, we do not guarantee specific results, sales, revenue, lead volume, cost-per-lead, return on ad spend, appointment bookings, or any other performance outcome.

Results depend on many factors outside our control, including but not limited to: market conditions, ad platform algorithms, the client’s sales process, pricing, product or service quality, geographic competition, seasonality, client follow-up speed and quality, and overall business operations.

Any case studies, testimonials, screenshots, or example results shared by Pelican Media Haus reflect individual client experiences and do not represent typical results or a guarantee of future performance.

5. Client Responsibilities

Clients agree to:

  • Provide accurate information, timely feedback, brand assets, and required materials
  • Maintain their own ad platform accounts, payment methods, and ad spend budgets (ad spend is billed directly by the platform, separate from Pelican Media Haus service fees)
  • Ensure their business complies with all applicable laws, including advertising laws, professional licensing, and consumer protection regulations
  • Honor and follow up with leads generated through our services in a timely, professional manner
  • Comply with the terms of service of any third-party platform on which their ads or content appear

6. Payment Terms

All fees are as outlined in the client’s signed service agreement. Payments are due on the schedule specified in that agreement. Late or missed payments may result in pause or suspension of services. Chargebacks initiated without a good-faith attempt to resolve the matter directly with Pelican Media Haus may be considered a material breach of this agreement and may result in collection activity and additional fees.

7. Cancellation and Refunds

Cancellation terms are defined in each client’s service agreement. Due to the nature of creative and advertising services — including work product already produced, time commitments, and media buys already placed — fees paid for work already performed are non-refundable except as explicitly stated in the applicable service agreement.

8. Intellectual Property

All creative content, scripts, video files, graphics, images, and deliverables produced by Pelican Media Haus remain the exclusive property of Pelican Media Haus until full payment is received. Upon full payment, ownership rights transfer to the client as outlined in the applicable service agreement. Pelican Media Haus retains the right to use completed work for portfolio, case study, and marketing purposes unless otherwise agreed in writing.

Client materials (logos, brand assets, footage, testimonials) provided to Pelican Media Haus remain the property of the client. By providing such materials, the client grants Pelican Media Haus a non-exclusive license to use them for the purpose of delivering services.

9. Third-Party Platforms

Our services involve third-party platforms (Meta/Facebook, Instagram, Google, YouTube, TikTok, CRM tools, scheduling tools, etc.), each with their own terms and policies. Pelican Media Haus is not responsible for, and shall not be liable for, any changes, outages, account suspensions, ad disapprovals, or policy enforcement actions taken by these platforms. Clients are solely responsible for complying with the terms of any platform on which their ads or content are run.

10. Testimonials and Case Studies

Any testimonials, reviews, or case studies published on our website or marketing materials reflect the real experiences of the individuals or businesses quoted. Results are not typical and may vary based on a wide range of individual factors.

11. Limitation of Liability

To the fullest extent permitted by law, Pelican Media Haus, Space Coast Aerial Solutions LLC, and its members, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost profits, lost revenue, lost leads, lost data, or reputational harm — arising out of or related to the use of our services, even if advised of the possibility of such damages.

In no event shall our total aggregate liability to any client exceed the total amount actually paid by that client to Pelican Media Haus in the three (3) months preceding the event giving rise to the claim.

12. Indemnification

Client agrees to indemnify, defend, and hold harmless Pelican Media Haus, Space Coast Aerial Solutions LLC, and its members, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from: (a) client-provided content or materials; (b) client’s products, services, or business practices; (c) client’s violation of any law or third-party rights; (d) client’s breach of these Terms; or (e) any claims that the client’s advertising is false, misleading, or non-compliant with applicable law.

13. Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, hurricanes, tropical storms, power or internet outages, government actions, pandemics, or platform-wide service disruptions.

14. Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith direct communication for a period of thirty (30) days. If the dispute remains unresolved, any dispute, controversy, or claim arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered in Brevard County, Florida, under the rules of the American Arbitration Association (AAA). Each party shall bear its own costs and attorneys’ fees, except as otherwise awarded by the arbitrator. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

15. Governing Law and Venue

These Terms shall be governed by and construed under the laws of the State of Florida, without regard to its conflict of law principles. Exclusive venue for any legal proceeding not subject to arbitration shall lie in the state or federal courts located in Brevard County, Florida, and the parties consent to the personal jurisdiction of those courts.

16. Compliance with Florida Law

Pelican Media Haus conducts all advertising and marketing activity in accordance with applicable Florida law, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, F.S. §§ 501.201 et seq.), the Florida Telephone Solicitation Act (F.S. § 501.059), and the Florida Digital Bill of Rights (F.S. §§ 501.701 et seq.), as well as applicable federal laws including the TCPA, CAN-SPAM Act, and FTC advertising and endorsement guidelines.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court or arbitrator, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any signed service agreement between client and Pelican Media Haus, constitute the entire agreement between the parties and supersede any prior understandings, communications, or agreements.
